eClouds is neither a Power Trader nor an Exchange online / offline. eClouds is a service provider to the generators and consumers of power, helping them sell their power or buy required power directly from or to the respective parties. eClouds unequivocally declares that we are an Aggregator of power generators and Power consumers and in no way are bound by the rules and laws governing them or the power traders. We do not bill any sale of power nor contract to supply power.

The persons enrolling themselves as members or clients of eClouds shall do so after satisfying themselves of all the commercial aspects, including the fees and charges levied under the terms and conditions mentioned herein. eClouds has taken all precautions possible to evaluate the members of this site, as is general practice. However, eClouds is not responsible for non-performance of any of the parties. Please note that the members will be executing direct contracts between themselves for any of the transactions between them. Any recourse taken shall be under such a contract, which shall explicitly cover the parties to that agreement and not eClouds. eClouds is a service provider for the increased performance of its members and is not liable for any losses sustained by the members, either directly or indirectly, due to supply or non-supply of power or any activity directly connected with this website or otherwise. Furthermore, eClouds is not liable for the performance of any of its members on or off this website.

By accessing this website, you agree to be bound by these Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark laws.

Use License:

1. Permission is granted to use the software on an "as is where is" basis. You may use the software present on this website as if you are reading a book and shall not at any point in time use it simultaneously from more than one device.


2. You may use the eClouds website for your own purpose, both commercial and personal, only after paying the due fees where specified. You may not use the software for displaying or commercial use of the data or use the data to procure any commercial advantage in any form by transferring to another site, another person, or mirroring the information on the eClouds website.


3. By using the eClouds website, you explicitly agree to make any due payments/usage charges tied to the commercial usage of any displayed data. Should you use the data and not pay due usage charges (UC), you are liable to pay the same under any claim by eClouds along with a penal interest of 18% from the date it fell due.


4. You may not modify or copy the software or download it for offline use at any point in time.


5. This is only a grant of license to use and not a transfer of title or ownership.


6. You may not use the information contained on our website either manually or through automated software such as scraping for any purpose other than those listed in this license.


7. You may not decompile, reverse engineer, or attempt to do so for any software contained in the eClouds website.


8. You may not remove copyright or other proprietary notices displayed on the website either universally or individually.


9. This license shall automatically terminate if you violate any of these restrictions and may be terminated by eClouds at any time if found to violate any of these clauses or others that may be in force from time to time.

The materials on the eClouds website are provided "as is." eClouds makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
2. The data displayed is made available to you as provided by eClouds members. The correctness of the displayed information lies with the members and not with eClouds.

Limitations:

In no event shall eClouds or its clients be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the eClouds website, even if eClouds or an authorized representative has been notified orally or in writing of the possibility of such damage.

Working Conditions:

While transacting business, clients are expected to submit necessary documents to eClouds and other clients to fulfill the business proposition placed on this website. Clients are deemed to have signed these terms and conditions and other agreements for the purchase of power with suppliers/consumers of power electronically, which shall be valid in a court of law once confirmed.

Revisions and Errata:

The materials appearing on the eClouds website could include technical, typographical, or photographic errors. eClouds does not warrant that any of the materials on its website are accurate, complete, or current. eClouds may make changes to the materials contained on its website at any time without notice but does not commit to updating them.

Governing Law:

Any claim relating to the eClouds website shall be governed by the laws of the Government of India without regard to its conflict of law provisions. All disputes and claims fall under the jurisdiction of the Courts in Coimbatore only.
